Topic: The Upcoming Changes To Overtime Exemption Regulations: What To Expect And How To Prepare

Changes to the regulations governing exemptions from the overtime provisions of the Fair Labor Standards Act are expected to impact employers this coming year.  New salary thresholds for exempt status are a virtual certainty.  Changes to the duties tests may come as well.  Even without imminent regulatory changes, prudent employers are reexamining employee classifications in light of the fact that wage and hour claims have become a growth industry for plaintiffs’ attorneys.

In this program, we will review the current tests for classifying employees as exempt.  We will then focus on how proposed changes are expected to impact these tests.  Finally, we will examine the steps employers should be taking to prepare for these changes and avoid costly pitfalls in this area.
